Family Law in Serbia

Divorce in Serbia is governed by the Family Law (“Porodični zakon”) and can be granted in two main ways: by mutual consent or at the request of one spouse.

Divorce by Mutual Consent in Serbia:                                                                                                      Spouses may request a divorce by mutual consent if they are able to agree on key matters, including:

  • Custody of minor children;
  • Child support payments;
  • Division of marital property;
  • Visitation rights for the non-custodial parent. The agreement on these issues must be approved by the court, which ensures that the best interests of the children are protected. This process is typically faster and less contentious.

                                                                                                                                                    Contentious Divorce in Serbia:                                                                                                                        If the spouses cannot reach an agreement, one spouse may request a divorce from the court by citing a legitimate reason. Grounds for divorce may include:

  • Infidelity;
  • Frequent and serious marital disputes;
  • Domestic violence;
  • Separation;
  • Any other behavior that makes continuing the marriage intolerable. In such cases, the court will not only examine the reasons for the divorce but also decide on child custody, support payments, and property division. Protective measures may be imposed if violence or abuse is involved.
